Text Courts in the United States All the courts in the United States are divided into two principal groups: federal and state courts. 12
Some federal courts are provided for in the Constitution of the USA. These courts are known as constitutional courts. Among these is the Supreme Court, which was organized according to the Judiciary Act passed by Congress in 1789. The same act established a system of constitutional federal courts of inferior jurisdiction. They are district courts and courts of appeals. District courts are the first courts to hear cases involving violation of federal laws. All the judges of constitutional courts are appointed for life by the President with the approval of the Senate. The Supreme Court is the highest appellate tribunal in the country. It exercises original jurisdiction in only two kinds of cases: if a case involves foreign diplomats and if a state is a party in this case. The Supreme Court is also the final judicial arbiter of federal constitutional questions. It ensures that all the laws and other normative acts passed or being considered by the supreme or local legislative bodies are constitutional. Other federal courts are called legislative courts. They are special courts established by Congress: the Claims Court, the Court of International Trade, the Tax Court, the Court of Military Appeals, the Customs Court, the Court of Customs and Patent Appeals, and territorial courts established in the federally administrated territories of the United States. Furthermore, each state has an independent system of courts operating under the constitution and laws of the state. The character and names of these courts differ from state to state, but all of them exercise general jurisdiction. The first local court that hears cases involving violation of state laws is a county court. Other local courts hear only one kind of cases. For example, small claims courts try cases involving small amounts of money. Probate courts handle family financial situations following a death. Other special courts deal with traffic accidents and disputes among family members. Higher state courts are known as circuit courts or superior courts. These courts hear more serious cases. Their decisions may also be appealed. The highest courts in most states are their supreme courts. The highest court in the nation is the United States Supreme Court. A person who loses a case in a federal appeals court or in the highest state court may appeal to the Supreme Court. If the Supreme Court agrees to re-examine the case, its decision will be final. The criminal procedure in the USA is somewhat different from that in Russia although it is based on the same principles, i.e. adversary proceeding, presumption of innocence, publicity, openness, and others. But it has some distinguishing characteristics. 13
The first difference between the Russian and American criminal procedure lies in their rules of jurisdiction. In the USA, there are federal and state crimes. Terrorism, kidnapping and coinage offence are federal crimes; murder, fraud and gangsterism are state crimes, in which every state determines its own terms of punishment, statutes of limitation, the order of the preliminary examination, and so on. By the way, the criminal legislation in California is the strongest one in the USA since illegal emigration causes a very high crime rate in this state. Exercise 1. Read and translate the text.
